Terms of Service

By accessing or using OnCited (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and the organization.

If you do not agree to these Terms, do not use the Service.

The Service is operated by Digital Hubz LLC ("we", "us", "our", "Company"), a limited liability company organized under the laws of Georgia.

OnCited offers two distinct services. These Terms apply to both unless a specific section says otherwise.

AI Visibility Tracker

A subscription-based software-as-a-service product that monitors how your brand, product, or chosen prompts appear across third-party AI search engines (including but not limited to ChatGPT, Perplexity, Gemini, Claude, and Google AI Overviews), surfaces source citations, and generates weekly action plans.

Ranking Service

A managed placement service in which we produce and publish authentic, human-written mentions of your brand on third-party platforms (including but not limited to Reddit, Quora, and independent blogs) to increase the likelihood that AI engines cite high-quality sources discussing your brand. Placements are subject to each third-party platform's own terms of service.

To use the Service, you must:

• be at least 18 years old (or the age of legal majority in your jurisdiction, if higher);
• provide accurate, current, and complete information when registering;
• keep your login credentials confidential and notify us promptly of any unauthorized access;
• be responsible for all activity that occurs under your account.

We may suspend or terminate accounts that we reasonably believe were created with false information or are being used in violation of these Terms.

Subscription plans

The AI Visibility Tracker is sold on a recurring subscription basis. Monthly subscriptions renew every month; annual subscriptions renew every 12 months. The Ranking Service is sold on a monthly recurring basis for ongoing tiers, or as a one-time purchase for fixed-volume engagements.

Payment

Fees are charged in advance through our third-party payment processor. You authorize us to charge your chosen payment method for all fees, applicable taxes, and any subsequent renewals until you cancel.

Failed payments

If a payment fails, we will attempt to charge your payment method again over a reasonable period. Access to the Service may be suspended if payment is not received within 14 days of the original charge date.

Taxes

All fees are stated exclusive of any applicable taxes (including value-added tax, sales tax, or withholding tax), which are your responsibility unless we are legally required to collect them.

Refunds

Refunds, if any, are governed by our Refund Policy, which forms part of these Terms.

You agree not to:

• reverse-engineer, decompile, or attempt to extract source code from the Service;
• scrape, crawl, or use automated means to access the Service except through documented APIs;
• resell, sublicense, or white-label the Service without our prior written consent;
• use the Service to monitor, track, or report on individuals (the Service is for brand and category research, not personal surveillance);
• upload content that is unlawful, infringes others' rights, or contains malicious code;
• interfere with the Service, its security, or other users' use of it;
• use the Service in violation of applicable export controls or sanctions.

The Ranking Service involves publishing content on third-party platforms. By purchasing the Ranking Service, you acknowledge and agree that:

• placements are produced by human writers and are subject to each platform's terms of service and community standards;
• we do not buy upvotes, run inauthentic accounts, or place spam content;
• we cannot guarantee that any individual post will remain published, will be cited by any specific AI engine, or will produce a specific visibility lift;
• once a post has been published on a third-party platform (e.g. Reddit, Quora), it cannot be unpublished by us at your discretion - third-party platform rules apply;
• we will use commercially reasonable efforts to deliver agreed placement volumes within the agreed time frame; if we do not, the Refund Policyapplies.

Your content

You retain all rights to the brand information, URLs, prompts, and other content you provide to us ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to use Your Content solely as needed to operate the Service for you, including for the Ranking Service, analytics, and any reporting you authorize.

Our platform

The Service, including its software, design, copy, models, methodology, and all related intellectual property, is owned by Digital Hubz LLC and licensed to you for the duration of your subscription under a limited, non-exclusive, non-transferable license. No rights are granted by implication.

Feedback

If you send us feedback or ideas, we may use them freely without obligation, attribution, or compensation.

The Service interacts with third-party services (including AI engines, search providers, hosting providers, payment processors, and publishing platforms). We are not responsible for those third parties' availability, accuracy, content, or policies. Your use of them is governed by their respective terms.

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• your AI visibility score, rank, or share of citations will increase;
• the Service will be uninterrupted, error-free, or that defects will be corrected;
• AI engines, third-party platforms, or external data sources will behave consistently or remain available.

To the maximum extent permitted by applicable law, in no event will Digital Hubz LLC, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the Service.

Our total cumulative liability for all claims arising out of or related to the Service will not exceed the greater of (a) the fees actually paid by you to us in the 12 months preceding the event giving rise to the claim, or (b) USD 100.

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, the limitations above apply to the maximum extent permitted.

You agree to indemnify, defend, and hold harmless Digital Hubz LLC and its officers, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) Your Content, or (c) your violation of any law or third-party right.

You may cancel your subscription at any time from inside the Service or by contacting support. Cancellation takes effect at the end of your current billing period.

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe that you have violated these Terms or that the action is necessary to protect the Service, our customers, or third parties.

On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and governing law) will survive.

These Terms are governed by the laws of Georgia, without regard to conflict-of-laws principles. The courts of Tbilisi, Georgia have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.

We may update these Terms from time to time. If we make a material change, we will notify you at least 30 days in advance by email or by a prominent in-product notice. Continued use of the Service after the effective date of the change constitutes acceptance of the new Terms.
